I acknowledge and agree as follows:

1. This is a promotion offer that starts on November 25th, 2022, at 12-00am, and ends on November 28th, 2022, at 11.59pm. The promotion period is 1 months, 2 months or 3 months at 50% of regular price, prepaid for the whole length of the promotion period. 
2. I have chosen to enter into the following program(s) and classes: MVP Zone Full Membership
3. The program starts on the day of submitting the initial payment and ends the day after the chosen promotion period ends. 
4. Upon completion of the promotion period I choose, the membership will roll over into regular recurring MVP Zone Full Membership at $39/weekly, until I cancel by emailing to help@mymvpzone.com. 
5. I can cancel this agreement from the day I enter the agreement within 5 days after I sign this agreement for a full refund of initial payment. Within the first 5 days I do not need a reason to cancel. MVP Zone has 30 days to refund.  
6. I can cancel the recurring membership anytime for any reason. MVP Zone has up to 48 hours to reply to my request to cancel and authorize the cancellation of the membership. All future recurring payments will be cancelled. I understand that I cannot request a refund of the past recurring payments for the period of time before I submit my request to cancel the recurring membership.
7. EFT Authorization: I authorize MVP Zone to transfer electronic funds from the checking, savings, or credit card account I provide for my membership dues. This authorization is to remain effective until MVP Zone has collected for all charges assessed in connection with the terms and conditions of this agreement.
8. Fees and dues will not be refunded due to non-attendance. Member is responsible for attending and/or cancelling memberships.
9. MVP Zone agrees to provide and the Student agrees to purchase competent instruction, supervised by qualified personnel trained in the procedures and traditions of such activities.
10. MVP Zone or any party designated by MVP Zone may photograph or film me while I attend classes of MVP Zone and use of any and all such photos, video footage and/or video streaming for promotion, sales, publicity and advertising purposes for all media, including, but not limited to, the internet.
11. The required physical exertion may be strenuous and cause physical injury, and I am fully aware of the risks and hazards involved. I hereby represent that I am physically fit to receive and participate in the offered course of instruction. I acknowledge that I have been advised to consult with a physician prior to and regarding my participation in the classes and that my physician has confirmed to me that I have no medical condition which would affect my full participation in the classes.
12. In consideration of my being permitted to participate in the classes, I for myself, my heirs, executors, administrators, successors, assigns and anyone else who may claim on my behalf hereby waive any and all claims, liability and damages I may now or in the future have against MVP Zone, its directors, officers, instructors and staff and all persons acting under its authority and their respective heirs, executors, administrators, successors, and assigns, arising by any means whatsoever, including, but not limited to death, injury, damages to or loss to my person or property of any kind whatsoever, no matter how caused arising from or in connection with my participation in the classes, however caused.
13. Some memberships include meal planning, grocery lists, recipes and remote training programming delivered through internet, email or app. I acknowledge that such meal plans and workouts are only a suggested plan, not a prescription meant to cure or treat any medical condition. I for myself, my heirs, executors, administrators, successors, assigns and anyone else who may claim on my behalf hereby waive any and all claims, liability and damages I may now or in the future have against MVP Zone, its directors, officers, instructors and staff and all persons acting under its authority and their respective heirs, executors, administrators, successors, and assigns, arising by any means whatsoever, including, but not limited to death, injury, damages to or loss to my person or property of any kind whatsoever, no matter how caused arising from or in connection with my participation in the meal plan, remote training program, however caused.
14. I further hereby release, remiss and forever discharge MVP Zone, its directors, officers, instructors and staff and all persons acting under its authority and their respective heirs, executors, administrators, successors, and assigns from and against all demands, claims, actions, damages, costs and expenses arising from or with respect to death, injury, damages to or loss to my person or property of any kind whatsoever, no matter how caused, arising from or in connection with my participation in the classes whether or not caused by, in whole or in part, the negligence or gross negligence of MVP Zone.
15. I will hold harmless and indemnify MVP Zone, its directors, officers, instructors and staff and all persons acting under its authority and their respective heirs, executors, administrators, successors, and assigns from any and all liability for any damage or injury to the property or persons of any third party resulting from my involvement in or presence during any of the classes.
16. I will comply with all the rules and regulations of MVP Zone and I will not share my username, password, workout links, or private group information. 
17. I will pay a service charge of $25.00 for any payments 10 days past due. If there are three payments which are 10 days past due during the period of this agreement, I agree to pay the remaining balance of the agreement in full, in addition to any and all recovery charges incurred.
18. I hereby agree that if MVP Zone is unable to process my payment from the designated account provided by me MVP Zone is permitted to use any of the other accounts information provided as many times and as often as needed to replace the unpaid payments and service charges as explained on section 10 of this agreement.
19. In addition to any rights and remedies it may otherwise have, MVP Zone may terminate this agreement upon ten days' written notice to me if I fail to comply with my obligations under this agreement and do not cure any such failure within ten days after receiving notice of such failure.
20. Failure to attend the classes does not relieve me of the obligation to pay the full tuition for the program or phase in which I am currently enrolled.
21. I confirm that the provisions in this agreement constitute the entire agreement between the parties hereto and supersede all prior communications, proposals, representations and agreements, whether oral or written with respect to the subject matter of this agreement.
22. MVP Zone is committed to protecting the privacy of personal data of our customers. We make every effort to ensure that the information you share with us is recorded accurately, retained securely and used only according to your wishes. We collect personal details necessary to communicate with you and manage our ongoing business relationship with you. If you have any questions about how your personal information is handled or distributed, or if you wish to receive a full copy of our full privacy policy, please contact our privacy officer.
23. I understand my rights and obligations as stated above. I confirm that I am the full age of eighteen years (unless otherwise indicated below) and that I have read and understood this release and waiver of liability and I am aware that by signing this agreement I am waiving certain legal rights, including the right to claim damages which I or my heirs, executors, administrators, successors or assigns may have against MVP Zone.

ASSUMPTION OF RISK: You agree that if you engage in any physical exercise or activity, including personal training, or enter our premises or use any facility or equipment on our premises for any purpose, you do so at your own risk and assume the risk of any and all injury and/or damage you may suffer, whether while engaging in physical exercise or not. This includes injury or damage sustained while and/or resulting from using any premises or facility, or using any equipment, whether provided to you by MVP Zone or otherwise, including injuries or damages arising out of the negligence of MVP Zone, whether active or passive, or any of MVP Zone affiliates, employees, agents, representatives, successors, and assigns. Your assumption of risk includes, but is not limited to, your use of any exercise equipment (mechanical or otherwise), sports fields, courts, or other areas, sidewalks, parking lots, or other general areas of any facilities, or any equipment related or not related to business of MVP Zone. You assume the risk of your participation in any activity, class, program, instruction, or event, including but not limited to weightlifting, walking, jogging, running, aerobic activities, volleyball, or any other sporting or recreational endeavor. You agree that you are voluntarily participating in the aforementioned activities and assume all risk of injury, illness, damage, or loss to you or your property that might result, including, without limitation, any loss or theft of any personal property, whether arising out of the negligence of MVP Zone or otherwise.

INDEMNIFICATION: By execution of this agreement, you hereby agree to indemnify and hold harmless MVP Zone from any loss, liability, damage, or cost MVP Zone may incur due to the provision of personal training or any other type of services by MVP Zone to you.

ACKNOWLEDGEMENTS: You expressly agree that the foregoing release, waiver, assumption of risk and indemnity agreement is intended to be as broad and inclusive as permitted by the law in the State of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. You acknowledge that MVP Zone offers a service to its clients encompassing the entire recreational and/or fitness spectrum. This release is not intended as an attempted release of claims of gross negligence or intentional acts.

PHOTO/VIDEO RELEASE: You grant permission to MVP Zone and its agents and employees the irrevocable and unrestricted right to reproduce the photographs and/or video images taken of you, or members of your family, for the purpose of publication, promotion, illustration, advertising, or trade, in any manner or in any medium. You hereby release MVP Zone and its legal representatives for all claims and liability relating to said images or video. Furthermore, you grant permission to use your statements that were given during an interview or any other activity related to business of MVP Zone, with or without your name, for the purpose of advertising and publicity without restriction. You waive your right to any compensation. 

You acknowledge that you have carefully read this waiver and release and fully understand that it is a release of liability, express assumption of risk and indemnity agreement. You are aware and agree that by executing this waiver and release, you are giving up your right to bring a legal action or assert a claim against MVP Zone for trainer’s negligence, or for any defective product used while receiving training from MVP Zone. You have read and voluntarily signed the waiver and release and further agree that no oral representations, statements, or inducement apart from the foregoing written agreement have been made.  Participant further agrees to strictly obey instructors and observe safety rules.
